General Conditions of Sale

1 )  OUR TRADE POLICY

These Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders for products on www.craftyourbag.com among www.craftyourbag.com users and the Seller.

2 ) HOW TO CONCLUDE THE CONTRACT WITH THE SELLER

  • 2.1 ) To conclude the purchase of one or more products on www.craftyourbag.com, you will need to fill out the electronic order form and send it to the Seller, by computer, following the relevant instructions.
  • 2.2 ) The order form contains a summary of information on the characteristics of each product ordered and its price (including all applicable fees and taxes), the type of payment that you can use to buy each product and methods of delivery of the purchased products, shipping costs and delivery.
  • 2.3 ) The contract is concluded when the Seller receives, by computer, your order form and after verifying the accuracy of data relating to your order.
  • 2.4 ) The order form will be filed in our database for the period of time required to process your order and as provided by law.
  • 2.5 ) Before the order confirmation you can always edit your data and correct, if necessary.
  • 2.6 ) The language available for concluding the contract with the Seller is Italian.
  • 2.7 ) Concluded the contract, the Seller will process your purchase order.
  • 2.8 ) The Vendor may not process your purchase orders that do not give sufficient guarantees of solvency or which are incomplete or incorrect, or expeditions in difficult locations or in the event of unavailability of products. In these cases we will inform you by e-mail that the contract has not been executed and that the Vendor has not carried out your purchase order specifying the reasons. If the products displayed on www.craftyourbag.com, are no longer available for sale at the time of your last access to the site or sending the order form, the Seller will inform you promptly and in any case within seven (7) days from the day following that on which you submitted your order to the Seller, the unavailability of the products ordered. In case of forwarding the order form and payment of the price, the seller will refund you the sum paid.
  • 2.9 ) By submitting the order form, you unconditionally accept and undertake to observe in relations with the Seller, these Conditions of Sale. If you do not agree with any of the terms in the General Conditions of Sale, please do not submit your order form for the purchase of products on www.craftyourbag.com.
  • 2.10 ) By submitting an order form, you agree and accept the Terms and Conditions of Sale and further information contained in www.craftyourbag.com, also through links, including the Privacy Policy Cookies and Information on Right of withdrawal.
  • 2.11) After the contract, the Seller will send you by e-mail, a receipt of the purchase. Information about the general conditions of sale and the information on the right of withdrawal and delivery costs are always accessible on the site www.craftyourbag.com.

3 ) WARRANTIES AND INDICATION OF THE PRICES OF PRODUCTS

  • 3.1 ) The main characteristics of products are shown on www.craftyourbag.com within each product page. The images and colors of products offered for sale on www.craftyourbag.com may not exactly correspond to the real effect of the Internet browser or monitor used.
  • 3.2 ) The prices of products may be subject to change. Make sure of the final sale price before sending the relevant order form.
  • 3.3 ) The purchase requests from countries not included among those displayed in the list in the order form will not be accepted by the Seller.
  • 3.4 ) The Seller, in case of exercise of your return right, is entitled not to accept the return of products that have been altered from their original status or have already been opened. The recognizable defects must be reported immediately and no later than seven days from receipt of goods. For the rest applies the term of legal guarantee. Warranty claims are limited, at our discretion, a rectification of defects or a replacement delivery. If these are not possible the customer has the right to terminate the contract. They are ruled. In any case there is a liability of the seller for any consequential damages or damages that occur at a later time. Also we not guarantee for defects resulting from use at or incorrect installation of the goods; also there is no warranty on parts subject to normal wear.

4 ) PAYMENTS

  • 4.1 ) For the payment of the price of the products and their shipping costs must be made one of the procedures indicated on the order form.

5 ) DELIVERY OF PRODUCTS

The specific method of delivery and delivery of products will be specified in the order form.

The Customer also undertakes to report promptly, but no later than 24 hours from the date of delivery, the Seller (via e-mail or registered mail with return receipt (“SB Fashion Bags di Simona Businelli”  – Via Benedetto Croce, 18 – 46047 Porto Mantovano (MN) – Italy) any and all eventual problems regarding the integrity, correspondence and/or completeness of the products received, under penalty of forfeiture.

7 ) RECESS

  • 7.1 ) You have the right to terminate its contract with the Seller, without penalty and without giving any reason, within fourteen (14) working days from the day of receipt of goods purchased on www.craftyourbag.com.
  • 7.2 ) To cancel the contract you must send the products in their original packaging and without any damage or alteration of the content to the point of withdrawal: “SB Fashion Bags di Simona Businelli”  – Via Benedetto Croce, 18 – 46047 Porto Mantovano (MN) – Italy.
  • 7.3 ) The only expenses that you incur are those relating to the cost of delivery to the point of withdrawal.
  • 7.4 ) The return right – besides compliance with the terms and procedures described in paragraphs 7.1, 7.2 and 7.3 – is exercised properly if the following conditions are fully met:
    * Products must not have been used or damaged;
    * Products must be returned in their original packaging;
    * The returned products must be delivered to the carrier, within fourteen (14) working days from the date (delivery date) in which you received the goods. It is understood that, in case of failure to timely receipt of the Products by the user for his absence, unavailability or erroneous indication to the address of delivery, to the delivery date shall be deemed as the date of filing of the notice of stock at the delivery address indicated in the purchase order submitted by you in respect of such products.
  • 7.5 ) If the return right is exercised in the manner and time limits specified in this paragraph 7, the Seller shall refund the amounts paid for the purchase of products.
  • 7.6 ) The money will be refunded as soon as possible and in any event within thirty (30) days from the date on which the Seller is aware of the exercise of your right of withdrawal, we will activate the procedures for reimbursement, once you verify the correct execution of the terms and conditions above, as indicated in paragraph 8.
  • 7.7 ) If they have not complied with the procedures and terms for the exercise of your right of withdrawal, as specified in this paragraph 7, you will not be entitled to reimbursement of the money paid to the Seller; However, it shall be entitled, at your expense, the products in the state in which they were returned to the Seller. Otherwise, the seller is entitled to keep the products in addition to sums already paid for their purchase.

8 ) TIME AND TERMS REDEMPTION

  • 8.1 ) After returning products, the Seller shall check the conformity thereof to the conditions and time limits specified in paragraph 7. In the event that the checks are successfully concluded, the Vendor will send you by e-mail, confirmation of acceptance of returned products.
  • 8.2 ) Whatever the mode of payment you used, the refund is activated by the Seller, as soon as possible and not later than thirty (30) days from the date on which the Seller is aware of the exercise of your right of cancellation after verification of the correct implementation of your right of withdrawal and acceptance of returned products.
  • 8.3 ) If there is no correspondence between the recipient of the products indicated in the order form and who made the payment of the sums due for their purchase, the repayment of sums, in the event of exercise of the right of withdrawal, it will be performed by the Seller in any case, against those who made the payment.
  • 8.4 ) The shipping costs for returned products will be your responsibility, including liability in case of loss or damage to the products.

10 ) APPLICABLE LAW AND SETTLEMENT OF DISPUTES

  • 10.1 ) The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree No 6 September 2005. 206, the code consumer, with specific reference to legislation on distance contracts and by Legislative Decree No 9 April 2003. 70 on certain aspects of electronic commerce.
    Under Article. 141-sexies, paragraph 3 of Legislative Decree 6 September 2005, n. 206 (Consumer Code), the Seller informs the user that has the capacity of consumer qualification in art. 3, paragraph 1, lett. a) that, of the Consumer Code in case he has lodged a complaint directly to the seller, after which however has not been possible to resolve the dispute so incurred; Seller will provide information about the body or the Alternative Dispute Resolution bodies for the extra-judicial settlement of disputes relating to claims arising from a contract concluded on the basis of these Conditions of Sale (defined ADR entities, as specified in Articles 141-bis and following of the Consumer Code), stating whether it intends to (the buyer) to make use or not of those bodies to resolve that dispute. The Seller informs the buyer that has the capacity of consumer qualification in art. 3, paragraph 1, lett. a) of the Consumer Code, which was set up a European platform for online dispute resolution for consumer disputes (ODR platform SO-CALLED). The ODR platform is available at the following address http://ec.europa.eu/consumers/odr/; through this ODR platform the consumer user can consult the list of ADR entities, find the link to the website of each of them and start an on-line dispute settlement proceedings in which it is involved.
  • 10.2 ) Shall remain unaffected in any case the consumer user’s right to apply to a competent ordinary courts of disputes arising from these Terms and Conditions, whatever the outcome of the court settlement procedure, as well as the possibility, where this can be justified, to promote an extra-judicial settlement of disputes relating to consumer relations through recourse to the procedures set forth in Part V, Title II bis of the consumer Code.
    They and www.craftyourbag.com agree to submit exclusively to the jurisdiction of the Court of Mantua.

11 ) MODIFICATION AND UPDATING

The General Conditions of Sale may be amended from time to time in consideration of possible regulatory changes. The new Terms of Sale shall be effective from the date of publication of www.craftyourbag.com
